These Terms of Use explain how Vitu Health B.V. provides the CareCircle app, wearable devices, and SOS watch, and what you agree to so every caregiver, wearer, and circle member stays protected.
The cards below highlight the most important promises, safety disclaimers, and account responsibilities. Read the full sections that follow for the complete binding agreement.
Agreement
Using the app, devices, or platform means you accept these Terms with Vitu Health B.V. If you disagree, do not create or continue an account.
Safety
The SOS watch is not a medical device or emergency service. Alerts notify your private Care Circle only, and location or connectivity gaps may affect accuracy.
Roles
The primary account holder manages billing and invitations, the wearer controls consent, and Care Circle members use data only for safety.
Billing
Subscriptions bill in advance. EU/EEA/UK consumers can withdraw within 14 days; otherwise access continues until the paid period ends.
Acceptable use
Monitoring requires explicit consent. No stalking, harassment, or hacking. Violations may lead to suspension without refund.
1. Agreement to Terms
These Terms of Use ("Terms") constitute a binding legal agreement between you and Vitu Health B.V. ("Vitu", "we", "us", or "our"), a company registered in the Netherlands.
These Terms govern your use of the Vitu CareCircle mobile application, Vitu wearable devices (including the SOS watch), and the Vitu platform (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Important Safety Disclaimers (Read Carefully)
The CareCircle Services and SOS watch are NOT medical devices. They do not provide medical diagnosis, treatment, or professional medical monitoring. The Services are designed to assist with general caregiving and peace of mind only.
The SOS button does NOT call emergency services (such as 112 in Europe or 911 in the US).
The Services rely on GPS, cellular networks, and battery life. You acknowledge that:
You should never rely solely on CareCircle for the safety or life-support of the Wearer.
3. User Roles and Responsibilities
Our Services involve three distinct user roles. You agree to the responsibilities of your specific role:

4. Subscriptions, Payments, and Cancellation
Some features require a paid subscription. Fees are billed in advance on a recurring basis (monthly or annually).
If you are a consumer in the EU/EEA or UK, you have the right to withdraw from your subscription contract within 14 days of the start date without giving any reason.
You may cancel your subscription at any time.
5. Acceptable Use Policy
You agree not to use the Services to:
Violation of this section allows Vitu to suspend or terminate your account immediately without refund.
6. Intellectual Property & Data
You retain all rights to the personal data and activity data you generate. You grant Vitu a license to process this data solely to provide the Services and as described in our Privacy Policy.
Vitu owns all rights to the App, the software, the firmware on the wearables, and the "CareCircle" brand.
7. Limitation of Liability
Please read this section carefully.
To the maximum extent permitted by law, Vitu and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Vitu’s total liability for any claim shall not exceed the greater of (a) €50, or (b) the amount you paid us in the past 12 months.
Nothing in these Terms excludes or limits Vitu’s liability for:
Subject to the above, Vitu is not liable for failures caused by third parties (e.g., GPS satellite failure, Vodafone/telecom outages) or for your failure to charge or use the device correctly.
8. Disputes and Governing Law
These Terms are governed by the laws of The Netherlands.
If you are a consumer residing in the EU, UK, or other jurisdictions with mandatory consumer protections, you may still benefit from the mandatory provisions of the law of your country of residence.
In the event of a dispute, we encourage you to contact us first at support@vitu.health to find a resolution. If we cannot resolve it, disputes shall be submitted to the competent courts of Amsterdam, The Netherlands.
9. Changes to Terms
We may update these Terms from time to time.
